Florida Design Works – Terms and Conditions

By accessing our website, placing an order, or engaging with any service provided by Florida Design Works (“we,” “our,” or “us”), you (“you” or “the client”) agree to be bound by the terms and conditions outlined below. These terms are intended to protect both the customer and Florida Design Works by clarifying our policies and expectations.

1. General Terms

Florida Design Works provides design materials and services including but not limited to tile, countertops, cabinetry, flooring, and related installation services. All quotes, sales, deliveries, and services are subject to these Terms and Conditions.

We reserve the right to update, modify, or change these Terms and Conditions at any time without prior notice to current or past customers. The most current version of these terms will always be available on our website.

2. Marketing and Communications

By submitting a form, placing an order, contacting us through our website, or engaging with any of our services, you agree to receive communications from Florida Design Works, including promotional and marketing messages via email, phone, or other channels.

If at any point you no longer wish to receive marketing messages, you may opt out by following the unsubscribe link in our emails or by contacting us directly with your request. Please note that transactional communications related to your order or project may still be sent regardless of marketing preferences.

3. Product Delivery and Lead Times

While we strive to meet all estimated delivery timelines, most product orders require an average of 12 weeks to fulfill. However, this timeframe is not guaranteed and may be affected by factors outside of our control, including but not limited to shipping delays, supplier availability, customs, natural disasters, or changes in project scope.

Florida Design Works is not responsible for any damages or losses resulting from delivery delays.

4. Product Variations and Batch Differences

Many of our products—especially tile, stone, and other natural materials—may vary slightly in color, pattern, tone, or texture from one batch to another. These differences can occur due to manufacturing variances, natural material characteristics, or environmental exposure over time.

Florida Design Works cannot guarantee a perfect color match between products from different batches. We can attempt to order material from the same batch or dye lot upon request, but this may extend the timeline of your project and could result in additional costs.

Clients are encouraged to review and approve samples prior to placing an order. Once the material is installed, any variations in color or tone are considered acceptable and will not be considered grounds for return or refund.

5. Changes to Orders

Any changes to your order must be submitted in writing and may result in additional charges and adjusted timelines. Florida Design Works is not responsible for delays or errors arising from last-minute changes or revisions made by the client after final approval.

6. Returns, Cancellations, and Refunds

All sales are considered final once orders are placed and approved. Custom and special-order items are non-refundable and non-returnable. Returns may be accepted on a case-by-case basis at the sole discretion of Florida Design Works and may be subject to restocking fees.

7. Liability Limitations

Florida Design Works is not liable for any indirect, incidental, or consequential damages that may arise from the use or installation of our products. Clients are responsible for verifying all dimensions, materials, and specifications prior to purchase and installation.

8. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida. Any legal action arising under these terms shall be brought exclusively in the courts located in Florida.
